This End User License Agreement ("Agreement" or "Terms of Use") governs your access to and use of the TheVictoryPlan mobile application ("App") and the website victoryplan.pro ("Website"), provided by TheVictoryPlan ("we", "us", "our").

By downloading, installing, or using our App, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our services.

1. Use of Service

1.1. Description of Service

TheVictoryPlan is an AI-powered calorie and nutrition tracking application that uses artificial intelligence and voice input technology. The App helps users achieve their healthy eating and weight management goals.

1.2. User Requirements

Age: You must be at least 13 years old to use the App. Users under 18 must obtain permission from a parent or legal guardian.
Account: You are responsible for maintaining the confidentiality of your account and all activities conducted under your account.
Accuracy of Information: You agree to provide accurate and up-to-date information when using the App.

1.3. Permitted Use

You may use the App and Website only for lawful purposes and in accordance with these Terms. You agree not to use the services:

In any way that violates applicable laws or regulations.
To transmit malicious code or viruses.
To interfere with the operation or security of the services.
To collect information about other users without their consent.
To create derivative products based on our App without our written consent.

2. Intellectual Property

All intellectual property rights in the App, Website, and their content (including but not limited to text, graphics, logos, icons, images, audio clips, software) belong to TheVictoryPlan or our licensors.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

3. Subscriptions and Payments

3.1. Premium Subscription

Some features of the App are available only through a paid Premium subscription. The following subscription plans are available:

Monthly Subscription: Billed monthly. Automatically renews each month unless cancelled at least 24 hours before the end of the current billing period.
Annual Subscription: Billed annually. Automatically renews each year unless cancelled at least 24 hours before the end of the current billing period.

3.2. Free Trial

We may offer a free trial period for new subscribers. If you do not cancel your subscription before the end of the free trial period, your subscription will automatically convert to a paid subscription, and you will be charged the applicable subscription fee.

3.3. Payment Processing

Payment Method: All payments are processed through the Apple App Store. Apple's terms and conditions apply to all transactions.
Pricing: Subscription prices may change. We will notify you of any price changes in advance. Price changes will take effect at the start of the next subscription period following the date of the price change.
Refunds: Refunds are handled in accordance with the Apple App Store refund policy. To request a refund, please contact Apple Support directly.

3.4. Cancellation

You may cancel your subscription at any time through your Apple ID Account Settings. Cancellation will take effect at the end of the current billing period. You will retain access to Premium features until the end of the period you have already paid for.

3.5. Auto-Renewal

Important: Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen subscription plan. You can manage your subscriptions and turn off auto-renewal by going to your Apple ID Account Settings after purchase.

4. Medical Disclaimer

IMPORTANT: TheVictoryPlan is intended for informational purposes only and does not constitute medical advice, diagnosis, or treatment.

The App does not replace consultation with a qualified medical professional, dietitian, or physician.
Before starting any weight loss program, dietary changes, or exercise regimen, consult your doctor.
Information provided by the App, including calorie calculations and nutritional recommendations, is approximate and may not be suitable for all users.
We are not responsible for any decisions made based on information from the App.

5. Disclaimer of Warranties

THE APP AND WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

The App will operate uninterrupted or error-free.
All defects will be corrected.
The App will be free from viruses or other harmful components.
The results of using the App will be accurate or reliable.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THEVICTORYPLAN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF OR INABILITY TO USE THE APP OR WEBSITE.

Our total liability to you for any claims arising under these Terms is limited to the amount paid by you (if any) for access to the App during the 12 months prior to the claim.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

8. Termination

We reserve the right to suspend or terminate your access to the App or Website at any time, with or without notice, for any reason, including but not limited to violation of these Terms.

You may stop using the App at any time by deleting it from your device.

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the App after the changes take effect constitutes your acceptance of the updated Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising in connection with these Terms or the use of the App shall be resolved through negotiation. If a dispute cannot be resolved through negotiation, it shall be referred to a competent court in accordance with applicable law.
